1. Introduction

These Terms and Conditions ("Terms") govern your use of the ProHealthix platform, including its web and mobile applications. By accessing or using ProHealthix, you agree to be bound by these Terms and our Privacy Policy.

2. Software and Licensing Model

ProHealthix is a SaaS solution licensed on a subscription basis. Biometric hardware may be purchased separately.

3. Eligibility

Users must be 18 years or older. Use by individuals under 18 is prohibited.

4. Account Creation and User Responsibilities

Users may register themselves or be added by gym admins. Responsibilities include safeguarding credentials and reporting unauthorized access. Accounts may be suspended or deleted for:

• Non-payment
• Breach of Terms
• Illegal or unethical conduct

5. Acceptable Use Policy

Users agree not to:

• Reverse engineer or disassemble the software
• Replicate or resell the platform
• Use it for illegal activities
• Compromise system security

Biometric Hardware Warranty Exclusions:

• Water or physical damage
• Power surges
• Unauthorized modifications

6. Warranty Policy

Limited warranty applies to biometric hardware used as per the manual. Not covered:

• Water damage
• Physical tampering
• Unauthorized modifications

• Email support@abrontech.com
• Include invoice proof
• Ship the device if needed

7. Subscription Plans, Billing, and Refund Policy

Plans: Basic, Advanced, Premium, Premium Plus (Monthly/Yearly)

• Trial may be available
• Data deleted if not paid within 15 days
• No refunds once subscription starts

8. Intellectual Property

All platform content and technology belong to Abron Technologies. Copying or reuse without permission is prohibited.

9. Data Collection and Protection

Data collected includes personal and fitness information. Refer to our Privacy Policy. Compliance with:

• IT Act, 2000
• Indian Contract Act, 1872
• E-Commerce Rules, 2020
• DPDP Act, 2023
• GDPR

Security includes encryption, firewalls, and cloud standards.

10. Third-Party Services

• Razorpay - Payments
• WhatsApp (Meta), Plivo - Communication
• OpenAI - AI Services
• AWS, Digital Ocean - Cloud

We are not liable for issues from these third-party services.

11. Termination of Services

• Breach of Terms
• Non-payment
• Illegal activities

All data is deleted and cannot be recovered after termination.

12. Limitation of Liability

Abron is not liable for indirect or consequential damages, including data loss or service disruption.

13. Modifications

We may update the platform or these Terms. Continued use indicates acceptance.

14. Jurisdiction

Governed by the laws of India. Disputes shall be settled in Thiruvananthapuram, Kerala.
